TERMS & CONDITIONS

1. GENERAL

1.1 The website and shop www.wyilda.com (henceforth referred to as the ”website”) is operated by Wyilda af Norden AB, a legal entity incorporated in Sweden with company registration number 559057-6665, located at Vojakkala 97, 95391 Haparanda. VAT registration number: SE559057666501.

These Terms & Conditions govern the use of the website, including the purchase of any products through the website. In the Terms & Conditions "you/your/customer" refer to you as a user of the website. “Wyilda/we/our” refer to Wyilda af Norden AB. Please read these Terms & Conditions before using the website or purchasing any products through the website. You accept these Terms & Conditions, in full, by doing any of the following:

  1. clicking on “accept” when presented with these Terms & Conditions on the website;
  2. purchasing any products through the website;
  3. registering a user account on the website; or
  4. otherwise using the website.

If you do not accept these terms, please do not register a user account, purchase products through the website or otherwise use the website.

1.2 You are not permitted to use the website for any illegal purposes, and you agree to use it in compliance with applicable laws and regulations. You shall not use the website in any way that could cause damage to the website. You also agree not to attempt any unauthorized access to any part of the website.

1.3 To purchase products from the website you must be at least 18 years old. If you are under 18 years of age or under guardianship, you need permission from a parent or guardian to purchase products from the website. You agree to provide truthful and correct information when placing an order or registering as a user.If we discover that you are younger than 18 years old or under guardianship, we will delete your account, and you may became liable for any costs that arise from an invalid contract.

1.4 You must take due care to protect your username and password against misuse by others and promptly notify Wyilda about any misuse. You, and your parent or legal guardian if you are a minor, are personally responsible for any use of the website or purchases from the website made through your username and password.

1.5 We may alter these Terms & Conditions from time to time, and by using the website following such changes you accept the new Terms & Conditions. It is your responsibility to read the Terms & Conditions prior to every order purchase on the website.

1.6 The contract for sales of other products will be solely between you and Wyildaand is governed by the laws of Sweden

1.7 If any provision of these Terms & Conditions is not valid or legally enforceable, that term will be deleted and the remaining terms will not be affected.

2. ORDER AND ACCEPTANCE

2.1 When you place an order on the website, and receive an order confirmation from Wyilda to the email address that you have submitted, a legally binding purchase agreement has been entered into.

2.2 The offer to sell the products described on the webshop is non-binding. Wyilda reserves the right to at any time after receiving your order to accept or decline your order, or any portion thereof.

2.3 If the webshop is not updated, and the item that you have ordered is out of stock, you will receive an email notification from Wyilda. You can then choose to purchase another item or cancel your order. If your credit card has already been charged for the purchase and your order is canceled, we will refund your credit card account.

2.4 If an item is listed at an incorrect price, at the time of your purchase, you may choose to buy the item to the correct price or cancel your order. If your credit card has already been charged for the purchase and your order is cancelled, we will refund your credit card account.

2.5 If Wyilda has any reason to suspect any kind of fraudulent behavior, we reserve the right to decline a purchase agreement.

3. CUSTOMER INITIATED ORDER CANCELLATIONS AND CHANGES

You can change or cancel your order at anytime before it has been dispatched. If you want to change or cancel an order after it has left the warehouse, you will need to follow the steps set out in our Delivery & Return Policy. Please see our Delivery & Return Policy here. 4. ORDER TRACKING

Standard delivery tracking can only be performed with some of Wyilda’s shipping destinations. A list of countries to which tracking is possible can be found on the website.

Express deliveries can be tracked. Once your order is dispatched you will receive a shipping confirmation email with a link to track your parcel. You can also follow your order on your My W account.

5. PRICES & PAYMENT

5.1 The prices shown in the webshop constitute the total price including the statutory Value Added Tax. Delivery costs and potential payment fees are not included in the price. For shipments outside the European Union other fees and taxes may be added to the price.

5.2 Wyilda is not bound by the prices shown in the webshop. The prices may change from one time to the next. If an item on the webshop is listed at an incorrect price, and the customer could reasonably understand that the price is incorrect, Wyilda is not bound to the listed price.

5.3 It is your responsibility that all the information related to the payment of your order (including without limitation: personal, address, payment, debit and credit card information) is correct and belongs to you. If Wyilda has any reason to believe that the information is incorrect we may require additional proof of your identity and/or cancel your purchase order. You are liable for all damages and costs that may arise from submitting inaccurate information.

5.4 Payments are done in the currencies set out in the webshop using credit or debit cards, bank transfer or invoice. Payment is made in Swedish krone (SEK) for shipments to Sweden, Norwegian krone (NOK) for shipments to Norway, Danish krone (DKK) for shipments to Denmark, British Pound for shipments to the UK (£), Euro (€) for shipments within the European Union and United States Dollar (USD) for all other shipping destinations. Wyilda uses payment services provided my Mondido Payments AB and Trustly Group AB. Further information about Mondido Payments services is available at www.mondido.com.

5.5 In all our shipping destinations purchases can be made with credit and debit card. This service is offered by Nets A/S and Teller A/S in accordance with their terms. For all credit or debit card payments, Wyilda acts solely as the marketer of the respective payment method and will provide the products to the customer. With regard to payments made by credit or debit card, the payment method provider acts as the merchant of the product and the trade transaction takes place between the customer and the payment method provider. The payment method provider is also the recipient of the payment. Thus, the payment method provider will handle all complaints and claims for compensation. 5.6 In 29 European countries, including Norway, purchases can be made via bank transfer. This service is offered by Trustly Group AB in accordance with their terms. 5.7 In Finland, Norway and Sweden purchases can be made via invoice. This service is offered by Collector Bank AB in accordance with their terms. Read about Collector Bank’s terms and conditions under paragraph 21 or in conjunction with payments on our online store.

5.8 When you place a purchase order on the website Wyilda may verify that the address you have stated is correct, your credit card is valid and that there is enough money on your bank account to pay for the entire order. We reserve the right to decline your purchase order.

5.9 Vouchers and/or discount codes

  1. are limited in time; personal; and only valid for one purchase.
  2. may not be combined with other offers; transferred to another purchase; or credited to a new item when making an exchange.

5.10 Discounted items are only available as long as they remain in stock. If a discount offer is limited in time, an item is only available to the discounted price, during the time stated.

5.11 All shipping costs are specified in the purchase order.

6. DELIVERY

6.1 Wyilda processes each purchase in the same order as we receive them on the webshop. We strive to dispatch your order within one business day after we have accepted and confirmed the order.

6.2 Time of delivery to our shipping destinations varies. Estimated delivery times can be found on the website. Wyilda cannot guarantee when an order will arrive. Shipping and transit times are only estimates provided by the shipping agent.

6.3 Shipping and handling charges will depend on the value of your order and the country to which the product is being shipped. Any customs duties or tariffs that may be imposed on the deliveries will be paid by you.

6.4 Wyilda reserves the right to deliver the ordered products in separate shipments.

6.5 A product that is delivered to you will become your property at the time that you receive it provided that Wyilda has received full payment for the product. Once Wyilda has delivered the product to you, you will become responsible for it and for any loss or damage to it thereafter.

7. DELAY

If your delivery has been delayed, you will receive an email notification from Wyilda. We will suggest a new time of delivery within 20 business days from the time that you placed your order. You may cancel your order at any time prior to shipping. We will refund you for your purchase.

8. NON-COLLECTED PACKAGE

Wyilda reserves the right to charge you for the entire shipping and processing cost for non-collected deliveries. Non-collected packages are not covered by our return policy.

9. DAMAGED PACKAGE

All dispatched orders are insured by Wyilda. If your package is damaged upon arrival, please take a picture of the damaged package and report any damages to the package to the postal agent and our customer service before opening the package. Wyilda replaces items that are damaged during shipment free of charge. If you discover the damage after opening the package, please contact our customer service.

10. RETURNS

10.1 Wyilda accepts returns within 14 days from the time of delivery. The return must be made in accordance and pursuant to the terms of Delivery & Return Policy.

10.2 Wyilda offers free returns within Sweden. Returns outside of Sweden are at the customer’s expense.

10.3 Return items must be unused and returned in its original packaging with the tag and/or sticker still attached. The Certificate of Authenticity must also be returned.

10.4 You are responsible for the return item(s) until it reaches Wyilda. If you choose to return your item(s) with another delivery service than the one recommended by us, it is yourresponsibility to ensure that the parcel is insured and traceable. Always keep the receipt of the shipment.

11. REFUNDS

If you choose to return an item the purchase amount will be refunded to you by the same payment method that you used when submitting your order. Your refund will be returned to your account within 30 days. We always strive to handle your return as quickly as possible.

12. EXCHANGES

Wyilda accepts exchanges within 14 days from the time of delivery. To exchange products purchased you will have to order a new product and return the original product(s). If you choose to exchange a product, you must cover the cost of the original shipment and return shipment, and other possible cost related to the return, of the original product purchased.

13. DEFECTIVE ITEMS

13.1 You must inspect the products delivered for any potential defects immediately after receipt, and if any are found, you must report these to Wyilda in writing as quickly as possible, not later than 24 hours after the delivery of the products.

13.2 Insignificant deviations in quality, color, size, etc. may not serve as grounds for a claim.

13.3 Should you receive a defective item this item will be repaired by Wyilda. If a repair is not possible the defective item will be replace with a new one. If a new item is not available you will be refunded for your purchase and the return cost.

13.4 Claims regarding the invoice amount should be made known to Wyilda in writing within 14 days from the time of delivery.

14. COLORS

Wyilda cannot guarantee that the colors appearing on the website in detail reflect the colors in reality. The colors can be reflected in different ways depending on your computer or phone screen, graphic card and the computer settings.

15. LIABILITY

Nothing in these Terms will exclude or limit our liabilityin the instance of fraud, death or personal injury or any other liability, which the law states may not be excluded or limited.

Wyilda will not be liable to you under a contract for:

  • any loss of profit, loss of income, loss of business, loss of revenue or loss of goodwill;
  • any loss or corruption of or damage to data; or
  • any loss or damage which was not a reasonably foreseeable result of either breach of a contract or breach of legal duty of care.

16. FORCE MAJEURE

Force majeure occurs when unforeseeable external circumstances prevent one or both parties from fulfilling their obligations under the contract. These circumstances are e.g. war, state intervention, strikes, staff’s illness, shipping disturbances, restrictions on energy supplies, bans, declined permissions, import and export restrictions, natural disasters etc. Force majeure applies to both Wyilda and to Wyilda’s sub-contractors. In the event of force majeure Wyilda has the right to postpone the delivery of the product(s) purchased by you. If the period of force majeure is not of a temporary nature, you as well as Wyilda have the right to cancel your purchase without payment.

17. PERSONAL INFORMATION

When you create your My W account and/or place an order through the web shop, you will be providing Wyilda with your personal information. Wyilda will use your personal information to process your order and for the delivery of the products ordered and for other limited purposes. Wyilda will collect and use your personal information in accordance with the terms of our Privacy policy.

18. INTERNET SCAMS

Wyilda will never email you requesting that you disclose or verify your credit card, bank information, password, or other personal information. If you receive an email that appears to be from Wyilda requesting such information, do not respond to it, and do not click on any links appearing in the email. Instead, please email our customer service, and we will investigate the matter.

19. DISPUTES

Any dispute regarding these Terms & Conditions will be settled in the court closest to where the defendant resides or conducts business. In accordance with the regulations set out in the Swedish Code of Judicial Procedure (1942:740), the customer has the right to file a lawsuit in the court where he/she resides. To avoid a legal dispute Wyilda encourages customers that disagree with these Terms and Conditions to contact customer service as a first attempt to resolve any conflict at hand.

21. COLLECTOR'S INVOICE SOLUTION

In collaboration with Collector Bank AB, Wyilda offer invoice and instalment payments. When you select Invoice as payment method, you receive your goods before you pay. You can then choose to pay the whole amount at once or to break up the payments into smaller instalments. The invoice will expire in 30 days. An invoice fee of 29 SEK is added.

You can only order for delivery to your registered address when you select invoice or instalment payment and you must be at least 18 years of age when you make the order. When you receive the invoice you can choose to pay instalments over up to 36 months by paying the lowest amount given in the invoice. When paying by instalments, interest of 19,9% per year is added.

Repayment

If you have paid the invoice but change your mind about the purchase you will receive a credit balance with Collector. For repayment of the credit we require contact and account details from you.
